Members of the European Parliament urge no more delays and justice for Berta Cáceres, finalist of the Sahkarov prize

On June 20, the hearing in which the conviction will be issued in this case should take place. The case has been described as extremely important for the European Union and essential for the protection of human rights defenders in Honduras and throughout the Latin American region. A year has passed since David Castillo was found guilty as co-author of the defender’s murder. The reading of the sentence has been delayed in more than four occasions. The procedural times established by Honduran law have expired. This situation puts the justice, reparation and guarentees of non-repetition process at high risk.

Javi Lopez, Member of the European Parliament from the S&D group comments:

“In June 2021, 61 Members of the European Parliament sent a letter to the Honduran authorities, including the former President of the Republic Juan Orlando Hernández, expressing their deepest concern over the unjustified delays in the judicial process for the murder of the Lenca indigenous leader Berta Cáceres.

We reiterate the call to the Honduran State to comply with its obligations to guarantee the right to the truth, access to justice and adequate, effective and prompt reparation for the victims, both the family of Berta Cáceres and of Honduran society as a whole that were impacted by the crime.”

Miguel Urbán Crespo, Member of the European Parliament from the Left stresses:

“Although we recognize the progress that has been made in this case, five years after Berta’s murder, we strongly condemn the lack of measures taken to provide truth, justice, reparation and guarantees so that these events do not happen again. That is why, in addition to the conviction adjusted to the criminal proceedings against David Castillo, we urge the Public Ministry to take rapid and concrete measures to apprehend and prosecute all the intellectual actors of the defender’s murder.

This case has shown the wildest side of regional capitalism, thanks to the relevance of the figure of Berta. But justice will only come until the power structures that protect the murders of human rights defenders are disrupted, as well as those who planned and ordered Berta’s crime are brought to trial.“

Tilly Metz, Member of the European Parliament from the Greens/EFA group concludes:

“The lack of justice for Berta Cáceres and the many defenders most murdered and attacked in Latin America for defending ancestral land rights and the environment remains systemic, but Berta’s case is a beacon of hope. Now, without more delays the conviction of David Castillo has to be issued.

The European policies that regulate the activities of European companies active in Latin America must promote a legal framework that protects the fundamental rights of the people. The proposed directive on due diligence is a step in the right direction, but we need to ensure that it becomes an efficient instrument to stop human rights and environmental violations in the entire supply chains. Above all, comprehensive protection measures must be promoted to protect human rights and environmental defenders, as well as to ensure that they can continue with their work.“

Miembros del Parlamento Europeo exigen, sin más dilación justicia para Berta Cáceres, finalista del Premio Sájarov

A fecha 20 de junio debe tomar lugar la audiencia en la que se emitiría la sentencia condenatoria en este caso, calificado de suma importancia para la Unión Europea y esencial para la protección de las personas defensoras de derechos humanos en Honduras y en toda la región de América Latina. La lectura de la sentencia se ha retrasado en más de cuatro ocasiones. Un año ha transcurrido desde la declaración de culpabilidad contra David Castillo como coautor del asesinato de la defensora. Los tiempos procesales establecidos por la ley hondureña han expirado. Esta situación pone en alto riesgo el proceso de justicia, reparación y garantías de no repetición.

“En junio 2021, 61 Miembros del Parlamento Europeo enviaron una carta a las autoridades hondureñas, incluido el por entonces presidente de la República Juan Orlando Hernández, expresando su más profunda preocupación por las dilaciones injustificadas en el proceso judicial por el asesinato de la líder indígena lenca Berta Cáceres.

A través de este medio reiteramos el llamado al Estado hondureño a cumplir con sus obligaciones de garantizar el derecho a la verdad, el acceso a la justicia y a una adecuada, efectiva y pronta reparación de las víctimas, tanto de la familia de Berta Cáceres como de la sociedad hondureña en su conjunto que fueron impactados por el crimen.”

“Si bien reconocemos los avances que se han logrado en este caso, cinco años después del asesinato de Berta, condenamos rotundamente la falta de medidas asumidas para brindar verdad, justicia, reparación y garantías para que estos hechos no vuelvan a repetirse. Es por ello que además de la sentencia condenatoria ajustada al proceso penal contra David Castillo, instamos al Ministerio Público a tomar medidas rápidas y concretas para aprehender y enjuiciar a todos los actores intelectuales del asesinato de la defensora.

Este caso ha puesto en evidencia el lado más salvaje del capitalismo regional, gracias a la relevancia de la figura de Berta. Pero la justicia solo llegará hasta que se trastoquen las estructuras de poder que amparan los asesinatos de defensores y defensoras, así como llevar a juicio a quienes planificaron y ordenaron el crimen de Berta.”

Tilly Metz, Miembro del Parlamento Europeo del Grupo de los Verdes, concluye:

“La falta de justicia para Berta Cáceres y las muchas personas defensoras asesinadas y agredidas en América Latina por defender los derechos territoriales ancestrales y el medio ambiente sigue siendo sistémica, pero el caso de Berta es un faro de esperanza. Ahora, sin más dilaciónse debe dictar la condena de David Castillo.

Las políticas europeas que regulan las actividades de las empresas europeas activas en América Latina deben promover un marco legal que proteja los derechos fundamentales de las personas. La directiva propuesta sobre diligencia debida es un paso en la dirección correcta, pero debemos asegurarnos de que se convierta en un instrumento eficaz para detener las violaciones de los derechos humanos y el medio ambiente en todas las cadenas de suministro. Sobre todo, se deben promover medidas de protección integral para proteger a las personas defensoras de derechos humanos y ambientales, así como para garantizar el espacio que puedan continuar con su labor.“
